Domestic violence is a pattern of controlling behaviors – violence or threats of violence – that one person uses to establish power over an intimate partner in order to control that partner’s actions and activities. Domestic violence means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member. There are two kinds of domestic violence cases; criminal and civil. Criminal domestic violence cases are when the police has arrested the person who is doing the abusing and has charged him/her with a crime. Civil domestic violence cases are more often referred to as “restraining orders” or “injunction for protection against domestic violence”. In order to obtain an injunction for protection against domestic violence against your spouse, partner or mother/father of your child, you must be able to swear under oath that you are either the victim of domestic violence as defined by statute or has reasonable cause to believe you are in imminent danger of becoming the victim of any act of domestic violence.
