Failure to Warn

Failure to Warn

A manufacturer, distributor or retailer can be held liable for a failure to provide adequate warnings for their product if the consumer suffers an injury as a result of their lack of warning. A proper warning will inform users of the proper way to use the product, the avoidable dangers involved when the product is used for its intended purpose, as well as what can occur if the consumer ignores the warning. Additionally,  manufacturers should warn users against foreseeable misuses of the product. A manufacturer’s failure to provide an adequate warning on their product may be the basis of a failure-to-warn claim in Florida. Contact the Kennedy Legal
