Drowning is still a leading cause of death for children ages one thru four, and the Centers for Disease Control and Prevention find that three children lose their lives every day. Many pool accidents happen because of reckless, negligent behavior, or lack of supervision. Florida has the Residential Swimming Pool Safety Act (RSPSA), which under this law, a property owner can be held negligent for failing to protect frail adults and children with at least one pool safety feature. Examples include pool covers, a four foot barrier around the entire pool, a pool entrance with a self-closing and self-locking device, or an alarm for all doors and windows that have direct access to the swimming pool. Keep in mind, this can happen at any type of pool, including, a hotel pool, a water park, a cruise ship pool, a private home pool or a friend's house. Florida property owners are required to maintain their properties in a reasonably safe condition, and to warn of any known dangers that exist.
